Platform Policy Update – Terms of Service Enforcement
As part of our ongoing effort to protect the integrity of SWAPD and maintain compliance with international regulations, we have introduced a critical update to our Terms of Service regarding service listings and third-party platform involvement.
Effective immediately, all sellers must comply with these new terms in order to continue using SWAPD. Failure to comply will result in account limitations or suspension.
The following clause has been added to our Terms of Service and is now in effect:
Third-Party Platform Compliance and Seller Warranties
Users offering services involving third-party platforms (including but not limited to social media platforms, messaging services, marketplaces, or websites) represent and warrant the following:
- They have full legal rights, authorization, or permission to offer the services listed.
- Their services do not violate any applicable laws, regulations, third-party platform terms, or intellectual property rights.
- Any required licenses, permissions, or platform authorizations are current and valid.
- They are solely responsible for ensuring their listing remains compliant with any applicable platform policies.
By listing a service, the seller agrees to indemnify and hold harmless SWAPD, its owners, staff, and affiliates from any and all claims, losses, damages, liabilities, or legal expenses (including attorney fees) arising from:
- Their breach of the representations made above;
- Any misrepresentation of their authority to perform the services;
- Violations of third-party platform terms or applicable laws caused by their actions or services.
SWAPD provides escrow and listing services as a neutral transaction facilitator. While we manage the financial flow between users and assist in dispute resolution, we do not create, endorse, or guarantee the legality, accuracy, or quality of any service listed on the platform. All responsibility for compliance with third-party terms and applicable laws rests entirely with the users involved in the transaction.
Upcoming Changes
In the coming weeks, we will roll out additional policies and tools designed to increase compliance and reduce risk across the platform. These include:
- A remove on the unauthorized sale of services that affect third-party websites.
- A comprehensive expansion of our prohibited items and services list.
- A seller screening process to verify whether providers hold the required permissions or qualifications to perform their services.
We recommend all sellers review the updated Terms of Service immediately. Continued use of SWAPD constitutes acceptance of these terms.
